IMPORTANT NOTICE TO ENCOMPASS™ SERVICE
CUSTOMERS
LIMITATIONS ON EMERGENCY SERVICES – 911
DIALING
Recent changes in Federal Law require that Enventis Telecom,
Inc. (“Enventis”) as the provider of your IP (Internet protocol)
telephony services, notify its customers of important differences
between the Encompass™ Service and traditional telephone
service, with respect to the availability of 911 or E911
services.

Limited Availability of Traditional 911 or E911
Dialing Service : The Encompass™ Service is designed
to permit callers to dial “911” and reach a local emergency
call center near your address. However, there are certain
circumstances where this service is not available, and
certain features of the service that are unlike traditional
911 or E911 dialing service:
- When a user dials 911 and reaches a local emergency call
center, the local emergency call center will not be able
to determine the user's exact location within the premises
or have the user's specific call-back number, but will
only receive information on the registered administrator
of user's Encompass™ phone system. The user must therefore
provide his or her specific location and telephone number
to the local emergency call center in order to get help.
- E911 dialing service is available through Encompass™ Service if customer is using a broadband connection without an analog (traditional landline telephone) line to support access to E911 dialing service. Broadband users must purchase E911 service before Encompass will be activated. The Enventis Support Center requires a 24 hour notice of a change of address for the E911 service on a broadband IP phone. Enventis has the right to de-activate any broadband phone that doesn't have E911 service or has been moved to a new address without proper notification to Enventis.
- 911 or E911 dialing service is not available through
Encompass™ Service if the customer is using a broadband
connection without an analog (traditional landline telephone)
line to support access to 911 and E911 dialing service.
- 911 or E911 dialing service is not available through
any “softphone” (a PC-based software phone) using the Encompass™ Service.
- 911 or E911 dialing service is not available if the user's
telephone handset has been moved or relocated from the
location where originally installed for the Encompass™ Service.
- 911 or E911 dialing service may not function in the event
of a power failure or disruption. If there is an interruption
in the power supply, the Encompass™ Service, including
911 dialing, may not function until power is restored.
Following a power failure or disruption, you may need to
reset or reconfigure equipment prior to using the Encompass™ Service,
including 911 dialing.
- Service outages due to suspension or termination of your
account will prevent all service, including 911 and E911
dialing, from functioning.
You should inform any person who may be present at the physical
location where you use the Encompass™ Service of these limitations
on the availability of traditional 911 or E911 dialing service.
Your service information from Enventis about the Encompass™ Service
should include a sticker for each phone handset concerning
the potential non-availability of traditional 911 or E911
dialing service. It is your responsibility to place the 911
sticker on each phone that you use with the Encompass™ Service.
If you did not receive a 911 sticker for each of your phones,
or you require additional 911 stickers, please contact a
customer service representative at 763-577-3956.
Enventis does not have any control over whether, or the
manner in which, Encompass™ Service calls to “911” are answered
or addressed by any local emergency response center. Enventis
disclaims all responsibility for the conduct of local emergency
response centers and the national emergency calling center.
Enventis relies on third parties to assist it in routing
911 calls to local emergency response centers. Enventis disclaims
any and all liability and responsibility in the event the
third party's data used to route calls is incorrect or causes
a wrong result. Enventis, its officers and employees will
not be liable for any claim, damage or loss, and you hereby
waive any and all such claims or causes of action arising
from or relating to 911 or E911 dialing service provided
through the Encompass™ Service, unless such claims or causes
of action arose from Enventis' gross negligence, recklessness
or willful misconduct. You will defend, indemnify and hold
harmless Enventis, its officers, directors, employees, affiliates
and agents, and any other service provider that furnishes
services to you in connection with the Encompass™ Service,
from any and all claims, losses, damages, fines, penalties,
costs and expenses (including without limitation attorneys'
fees) by, or on behalf of, you or any third party relating
to the absence, failure or outage of the Encompass™ Service,
including 911 or E911 dialing service, incorrectly routed
911 calls, and/or the inability of any user of the Encompass™ Service
to be able to use 911 or E911 dialing service, or to access
emergency service personnel.
